I need help regarding the Indonesian regulation on copyright transfer

I sold a logo to an Indonesian company last year. They had emailed me for copyright transfer confirmation which already been given by the site once the logo is sold. The company want to make their own written agreement on the logo copyright which I agreed to signed. but now the company asking me to go to Indonesia because "according to Indonesian regulations regarding the transfer of Copyright, it must be signed in the presence of a Notary".

So my question:
1. Is it true Indonesian regulation needed someone to be presence in signing those?
2. Can the document just be mail to me and I will get it notarized in my own country?

I have a customer from one of the large mining companies in Indonesia. I've created a lot of logos for them. But I have never been invited to the Indonesian capital city. I think they are still using old and outdated fashion way registration. There are many ways to take care of that. You should look for a solution to that problem on the internet and educate them how registration is done in today's era. Or you should raise your logo fee higher so that you don't have to pay for a trip to Indonesia yourself (they will def pay for you). Or you can cancel the purchase if you feel the process is very complicated and annoyed to handle.

Best regrads,

Korzuen,

Just in case, regarding the client’s written agreement, make sure that you are not waiving all moral rights.

In legal terms, the words “moral rights” have a very specific definition, which is fairly complex, but in general, moral rights include, among other things, rights of attribution and association (in other words: authorship). To put it plainly, if you sign an agreement waiving all moral rights, then the client can claim that he/she created the design himself/herself.

Concerning the need of a notary, you should take the time to carefully read the following research article, which is specific to Indonesia, and which was published on the Journal of Legal Reform (Jurnal Pembaharuan Hukum), which is an academic publication focusing on the Indonesian justice system.

Article title: Notary Authority in Making Authentic Deeds Regarding Copyright
https://researchgate.net/publication/365580818

Next, if needed, you should seek professional legal advice from a qualified attorney versed in international copyright law.

I really hope this helps,

Ortega Graphics

@ava_nauval
Thanks for the input. They already bought the logo. I actually caught them using it without my permission, that how the sale happened. They actually offer to pays the cost of me going there but I couldn't find the time to travel right now.

@Ortega Graphics

@korzuen

maybe it is necessary for some conditions. the price of a logo project exceeds a total of 10 million Indonesian rupiah. Sometimes in Indonesia the presence of a logo maker is required for signing and other matters related to the sale of the logo.

@korzuen don't forget to visit us as Indonesian logoground designers
